D\u00fcnya genelinde y\u00fczbinlerce can kayb\u0131n\u0131n ya\u015fand\u0131\u011f\u0131 Korona vir\u00fcs nedeniyle D\u00fcnya Sa\u011fl\u0131k \u00d6rg\u00fct\u00fc salg\u0131n\u0131, <a href=\"https:\/\/www.who.int\/emergencies\/diseases\/novel-coronavirus-2019\">11.03.2020 tarihinde Pandemi olarak ilan etmi\u015f<\/a> ve durumun Uluslararas\u0131 Kamu Sa\u011fl\u0131\u011f\u0131 Acil Durumu (PHEIC) oldu\u011funu a\u00e7\u0131klam\u0131\u015ft\u0131r.  <em>M\u00fccbir Sebep<\/em><\/p>\n\n\n\n<p><a href=\"https:\/\/www.aa.com.tr\/tr\/koronavirus\/turkiye-koronavirus-icin-etkin-onlemler-aldi\/1765471\">T\u00fcrkiye\u2019de ilk vaka 11 Mart tarihinde g\u00f6r\u00fclm\u00fc\u015ft\u00fcr<\/a>. Bu tarihten itibaren vir\u00fcs\u00fcn yay\u0131lmas\u0131n\u0131n \u00f6nlenmesi m\u00fccadelesinde pek \u00e7ok tedbir al\u0131nm\u0131\u015ft\u0131r. B\u00f6ylece bir anda ortaya \u00e7\u0131kan sosyo-ekonomik durum bir\u00e7ok hukuki soru ve sorunu da beraberinde getirmi\u015ftir. Bu hukuki sorunlar aras\u0131nda ilk akla gelenlerden biri taraflar aras\u0131ndaki s\u00f6zle\u015fmelerin mevcudiyetini devam ettirip ettiremeyece\u011fi ve pandeminin, pandemi nedeni ile al\u0131nan tedbirlerin ve sonucunda ortaya \u00e7\u0131kan sosyo-ekonomik durumun s\u00f6zle\u015fmelere etkileridir. <\/p>\n\n\n\n<h2 id=\"h-covi-d-19-salgini-m-cbi-r-sebep-sayilir-mi\"><strong>COV\u0130D-19 SALGINI M\u00dcCB\u0130R\nSEBEP SAYILIR MI?<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>\u00d6ncelikle D\u00fcnya Sa\u011fl\u0131k \u00d6rg\u00fct\u00fc (WHO) 11 Mart 2020 tarihinde, K\u00fcresel <a href=\"https:\/\/www.kureselhukuk.com\/en\/kuresel-hukuk-dergisi\/\">Covid-19 salg\u0131n\u0131n\u0131 <\/a>t\u00fcm \u00fclkeleri kapsayan \u2018\u2019 pandemik hastal\u0131k \u2018\u2019 olarak ilan etti\u011fini duyurmu\u015ftur. <\/p>\n\n\n\n<p>6098 say\u0131l\u0131 T\u00fcrk\nBor\u00e7lar kanununda a\u00e7\u0131k bir m\u00fccbir sebep tan\u0131m\u0131 verilmemi\u015f, durumun hal ve\n\u015fartlar\u0131na g\u00f6re de\u011ferlendirilebilece\u011fi hususu d\u00fczenlenmi\u015f; i\u00e7eri\u011finin\nbelirlenmesi i\u00e7tihatlara ve doktrine b\u0131rak\u0131lm\u0131\u015ft\u0131r. Bu ba\u011flamda,\ndoktrinde&nbsp;<em>\u201cSorumlu veya bor\u00e7lunun faaliyet ve i\u015fletmesi d\u0131\u015f\u0131nda meydana gelen,\ngenel bir davran\u0131\u015f normunun veya borcun ihl\u00e2line mutlak ve ka\u00e7\u0131n\u0131lmaz bir\n\u015fekilde yol a\u00e7an, \u00f6ng\u00f6r\u00fclmesi ve kar\u015f\u0131 konulmas\u0131 m\u00fcmk\u00fcn olmayan ola\u011fan\u00fcst\u00fc bir\nolay\u201d<\/em>&nbsp;&nbsp;\u015feklindeki tan\u0131ma yer verilmi\u015ftir.&nbsp; <\/p>\n\n\n\n<p>Ayn\u0131\nzamanda&nbsp;Yarg\u0131tay Hukuk Genel\nKurulu\u2019nun 2017\/11-90 E. 2018\/1259 K. Say\u0131l\u0131 ve 27.06.2018 tarihli karar\u0131 \u015f\u00f6yledir:<em> \u201cm\u00fccbir\nsebep, sorumlu veya bor\u00e7lunun faaliyet ve i\u015fletmesi d\u0131\u015f\u0131nda meydana gelen,\ngenel bir davran\u0131\u015f normunun veya borcun ihl\u00e2line mutlak ve ka\u00e7\u0131n\u0131lmaz bir\n\u015fekilde yol a\u00e7an, \u00f6ng\u00f6r\u00fclmesi ve kar\u015f\u0131 konulmas\u0131 m\u00fcmk\u00fcn olmayan ola\u011fan\u00fcst\u00fc bir\nolayd\u0131r. Deprem, sel, yang\u0131n,&nbsp;SALGIN HASTALIK&nbsp;gibi do\u011fal afetler\nm\u00fccbir sebep say\u0131l\u0131r.\u201d<\/em><\/p>\n\n\n\n<ul><li>Yarg\u0131tay kararlar\u0131nda m\u00fccbir\nsebebin unsurlar\u0131 \u015fu \u015fekilde belirtilmi\u015ftir:<em>&nbsp;<br>\n\u201c\u00d6ncelikle m\u00fccbir sebep, zorlay\u0131c\u0131 bir olayd\u0131r. Bu olay do\u011fal,\nsosyal veya hukuki bir olay olabilece\u011fi gibi insana ba\u011fl\u0131 be\u015feri bir olay da\nolabilir. Bu olay, zarar verenin faaliyet ve i\u015fletmesi d\u0131\u015f\u0131nda kalan bir olay\nolmal\u0131d\u0131r. M\u00fccbir sebep sebebiyle zarar veren, bir davran\u0131\u015f normunu veya s\u00f6zle\u015fmeden\ndo\u011fan bir borcu ihlal etmi\u015f olmal\u0131d\u0131r. Yine m\u00fccbir sebep, davran\u0131\u015f normunun\nihlali ya da borca ayk\u0131r\u0131l\u0131\u011f\u0131n sebebi olmal\u0131 ve ka\u00e7\u0131n\u0131lmaz bir \u015fekilde buna yol\na\u00e7m\u0131\u015f olmal\u0131d\u0131r. Ka\u00e7\u0131n\u0131lmazl\u0131k kavram\u0131, m\u00fccbir sebep y\u00f6n\u00fcnden kar\u015f\u0131 konulmazl\u0131k\nve \u00f6nlenemezlik kavram\u0131n\u0131 da kapsar. M\u00fccbir sebebin bir di\u011fer unsuru ise\n\u00f6ng\u00f6r\u00fclmezliktir.<\/em> \u2018\u2019<\/li><\/ul>\n\n\n\n<p>D\u00fcnya Sa\u011fl\u0131k\n\u00d6rg\u00fct\u00fc\u2019n\u00fcn 12.03.2020 tarihli karar\u0131nda, Korona vir\u00fcs\u00fcn\u00fcn \u201cPandemi\u201d (K\u00fcresel\nSalg\u0131n) olarak ilan edilmi\u015f ve k\u00fcresel risk seviyesi \u201cy\u00fcksekten\u201d \u201c\u00e7ok y\u00fcksek\u201d\nseviyesine \u00e7\u0131kar\u0131lm\u0131\u015f, ayr\u0131ca Cumhurba\u015fkanl\u0131\u011f\u0131\u2019nca al\u0131nan kararlarda, halka\nzorunlu olmad\u0131k\u00e7a soka\u011fa \u00e7\u0131kmamas\u0131 tavsiye edilmi\u015f, e\u011fitime ara verilmi\u015ftir. Yurtd\u0131\u015f\u0131\nu\u00e7u\u015flar\u0131 durdurulmu\u015f, \u015fehirleraras\u0131 yolculuk yasaklanm\u0131\u015ft\u0131r. Bununla beraber\nyarg\u0131lama faaliyetlerine ili\u015fkin tedbir kararlar\u0131 al\u0131nm\u0131\u015f ve genelgeler ile\nhalka a\u00e7\u0131k i\u015fyerlerinin b\u00fcy\u00fck b\u00f6l\u00fcm\u00fc kapat\u0131lm\u0131\u015ft\u0131r. Mevcut durum dikkate\nal\u0131nd\u0131\u011f\u0131nda, ya\u015fan\u0131lan k\u00fcresel salg\u0131n\u0131n \u00f6nceden \u00f6ng\u00f6r\u00fclemeyecek, ola\u011fan\u00fcst\u00fc bir\ndurum oldu\u011fu ortadad\u0131r. D\u00fcnya \u00fczerindeki somut etkilerini de dikkate al\u0131rsak,\nsalg\u0131n hastal\u0131\u011f\u0131n\u0131n m\u00fccbir sebep olarak kabul edilmesi i\u00e7in ba\u015fkaca g\u00f6sterge\ngerekmemektedir.<\/p>\n\n\n\n<h2 id=\"h-m-cbi-r-sebebi-n-ki-ra-s-zle-meleri-ne-etki-si-nedi-r\"><strong>M\u00dcCB\u0130R SEBEB\u0130N K\u0130RA S\u00d6ZLE\u015eMELER\u0130NE ETK\u0130S\u0130\nNED\u0130R?<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>Yukar\u0131da da de\u011finildi\u011fi \u00fczere maruz kal\u0131nan olay m\u00fccbir sebep olarak\nkabul edilse dahi, bu durum direkt \u201cbor\u00e7tan kurtulma\u201d nedeni olarak\nsay\u0131lmamaktad\u0131r.<\/p>\n\n\n\n<p>Bor\u00e7lar Kanunu\u2019nun\n138. Maddesi uyar\u0131nca;&nbsp;<em>\u201c&nbsp;S\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 s\u0131rada&nbsp;taraflarca \u00f6ng\u00f6r\u00fclmeyen&nbsp;ve&nbsp;\u00f6ng\u00f6r\u00fclmesi de beklenmeyen ola\u011fan\u00fcst\u00fc durum&nbsp;bor\u00e7ludan\nkaynaklanmayan bir nedenle ortaya \u00e7\u0131karsa, bor\u00e7lu h\u00e2kimden s\u00f6zle\u015fmenin yeni\nko\u015fullara g\u00f6re&nbsp;uyarlanmas\u0131n\u0131&nbsp;veya\ns\u00f6zle\u015fmeden d\u00f6nme hakk\u0131n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe konulmas\u0131n\u0131 ister.\u201d<\/em><\/p>\n\n\n\n<p>Doktrinde yer\nalan g\u00f6r\u00fc\u015flere g\u00f6re;&nbsp;\u201c&nbsp;<em>Bor\u00e7lu,\nborcunu ifa edememesinin m\u00fccbir sebepten ileri geldi\u011fini&nbsp;ispat ederek&nbsp;mesuliyetten\nkurtulabilir. M\u00fccbir sebep, akdi mesuliyette, bor\u00e7lunun borcunu yerine\ngetirmesinin kusurundan ileri gelmedi\u011fini g\u00f6steren bor\u00e7luyu mesuliyetten\nkurtaran bir hadisedir.\u201d(Prof. Dr. Haluk Tando\u011fan-T\u00fcrk Mesuliyet Hukuku-Sayfa\n467-468)<\/em><\/p>\n\n\n\n<p>Yukar\u0131da\na\u00e7\u0131klad\u0131\u011f\u0131m\u0131z kanun maddeleri ve doktrin g\u00f6r\u00fc\u015flerine g\u00f6re, bor\u00e7lunun \u00f6ncelikle\nborcunu ifa edememesinin nedeninin m\u00fccbir sebepten kaynakland\u0131\u011f\u0131n\u0131 ispat etmesi\ngerekmektedir. \u00c7\u0131kar\u0131lan\ngenelgeler ve verilen sosyal izolasyonu sa\u011flay\u0131c\u0131 zorunlu neticesinde sosyal ve ekonomik anlamda \u00f6ng\u00f6r\u00fclemeyen bir ma\u011fduriyet ortaya\n\u00e7\u0131kard\u0131\u011f\u0131 ku\u015fkusuzdur. <\/p>\n\n\n\n<p>Bor\u00e7lar Kanunu\u2019nun\nkira s\u00f6zle\u015fmesi h\u00fck\u00fcmlerinde i\u015fyeri kirac\u0131lar\u0131 y\u00f6n\u00fcnden bo\u015fluklar oldu\u011fu\ng\u00f6r\u00fclmektedir. Bor\u00e7lar Kanunu\u2019nun 331. Maddesinde;&nbsp;<em>\u201cTaraflardan her\nbiri, kira ili\u015fkisinin kendisi i\u00e7in \u00e7ekilmez hale getiren \u00f6nemli sebeplerin\nvarl\u0131\u011f\u0131 durumunda, s\u00f6zle\u015fmeyi yasal fesih bildirim s\u00fcresine uyarak her zaman\nfeshedebilir\u201d<\/em>&nbsp;h\u00fckm\u00fc\nmevcuttur. Asl\u0131nda bu madde i\u015fyeri\nkiralar\u0131 a\u00e7\u0131s\u0131ndan y\u00fcr\u00fcrl\u00fckte olsa dahi bu soruna \u00e7\u00f6z\u00fcm getirmemektedir. <\/p>\n\n\n\n<p>\u0130\u015fyeri\nkira s\u00f6zle\u015fmeleri a\u00e7\u0131s\u0131ndan; 31.3.2011 tarihli ve 6217 Say\u0131l\u0131 Yarg\u0131 Hizmetlerinin\nH\u0131zland\u0131r\u0131lmas\u0131 Amac\u0131yla Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun ile yeni\nTBK ile getirilen baz\u0131 maddelerin uygulanmas\u0131 ertelenmi\u015ftir. \u0130lgili kanunun Ge\u00e7ici\n2. Maddesi ile tan\u0131d\u0131\u011f\u0131 8 y\u0131ll\u0131k s\u00fcre, 2020 y\u0131l\u0131n\u0131n temmuz ay\u0131nda dolacak ve kirac\u0131s\u0131n\u0131n\nT\u00fcrk Ticaret Kanunu\u2019nda tacir olarak say\u0131lan ki\u015filer ile \u00f6zel hukuk ve kamu\nhukuku t\u00fczel ki\u015fileri oldu\u011fu i\u015fyeri kiralar\u0131nda yeni TBK ile gelen ve bu tarihe\nkadar uygulanmayan 9 maddesi uygulanmaya ba\u015flanacakt\u0131r. \u0130lgili maddeler\nuygulanmaya ba\u015flanana kadar, kira s\u00f6zle\u015fmelerinde belirtilmi\u015f olan ve kirac\u0131\na\u00e7\u0131s\u0131ndan daha iyi \u015fartlar sa\u011flayan maddelere ili\u015fkin olarak s\u00f6zle\u015fme\nserbestisi gere\u011fi kira s\u00f6zle\u015fmesinin h\u00fck\u00fcmleri uygulan\u0131r. S\u00f6zle\u015fmede\nd\u00fczenlenmeyen durumlar i\u00e7in ise m\u00fclga edilen Bor\u00e7lar Kanunun h\u00fck\u00fcmleri ele\nal\u0131n\u0131r. Bu sebeple;\nola\u011fan\u00fcst\u00fc bir sebep mevcut olsa dahi fesih bildirimi i\u00e7in yasal fesih s\u00fcrelerine\nuygun olarak bildirim yap\u0131lmal\u0131 d\u00f6nem sonunun beklenmesi gerekmektedir. <\/p>\n\n\n\n<p>E\u011fer ki s\u00f6zle\u015fmede salg\u0131n hastal\u0131k durumu bir m\u00fccbir sebep\nolarak d\u00fczenlenmi\u015f ise sonu\u00e7lar\u0131 da belirlenmi\u015f\ndemektir ve buna g\u00f6re s\u00f6zle\u015fme ile bu duruma ba\u011flanan hukuki sonu\u00e7lar uygulanacakt\u0131r.<\/p>\n\n\n\n<p>S\u00f6zle\u015fmede salg\u0131n hastal\u0131klar\u0131n m\u00fccbir sebep olaca\u011f\u0131na dair bir madde\nd\u00fczenlenmemi\u015f ise somut olay \u015fartlar\u0131\nincelenerek m\u00fccbir sebep halinin de\u011ferlendirilmesi gerekmektedir. Genel kural olarak T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 136\u2019nc\u0131\nmaddesinde m\u00fccbir sebep ve ola\u011fan\u00fcst\u00fc hali d\u00fczenledi\u011fi kabul edilmelidir.<\/p>\n\n\n\n<h3 id=\"h-covi-d-19-sebebi-yle-i-fa-i-mk-nsizli-i-ge-i-ci-i-fa-i-mk-nsizli-i-ve-a-iri-i-fa-g-l-h-k-mleri-ni-n-uygulanmasi\"><strong>COV\u0130D-19 SEBEB\u0130YLE \u0130FA \u0130MK\u00c2NSIZLI\u011eI, GE\u00c7\u0130C\u0130 \u0130FA \u0130MK\u00c2NSIZLI\u011eI VE\nA\u015eIRI \u0130FA G\u00dc\u00c7L\u00dc\u011e\u00dc H\u00dcK\u00dcMLER\u0130N\u0130N UYGULANMASI:<\/strong><strong><\/strong><\/h3>\n\n\n\n<h4 id=\"h-i-fa-i-mk-ns-zl\">\u0130fa \u0130mk\u00e2ns\u0131zl\u0131\u011f\u0131;<\/h4>\n\n\n\n<p>Taraflar aras\u0131nda akdedilen kira s\u00f6zle\u015fmesinde; bir m\u00fccbir sebep\nkayd\u0131n\u0131n bulunmamas\u0131 halinde g\u00fcndeme gelecek h\u00fck\u00fcm,TBK madde 136\u2019da\nifade edilmi\u015ftir.<\/p>\n\n\n\n<p>Her somut olaya g\u00f6re ilgili kira s\u00f6zle\u015fmesinden do\u011fan borcun ifas\u0131n\u0131n\nge\u00e7ici olarak m\u0131 yoksa s\u00fcrekli olarak m\u0131 imk\u00e2ns\u0131zla\u015ft\u0131\u011f\u0131n\u0131n tespiti\nyap\u0131lmal\u0131d\u0131r. Bilindi\u011fi \u00fczere Kira s\u00f6zle\u015fmeleri s\u00fcrekli edim borcu do\u011furan\ns\u00f6zle\u015fme tipleridir. Korona vir\u00fcs salg\u0131n\u0131nda yap\u0131lan m\u00fccadelede al\u0131nan\ntedbirler de ge\u00e7ici s\u00fcreli oldu\u011fundan s\u00fcrekli bir ifa imk\u00e2ns\u0131zl\u0131\u011f\u0131ndan s\u00f6z\nedilmemektedir \u00e7\u00fcnk\u00fc tedbir kararlar\u0131 sona erdi\u011finde imk\u00e2ns\u0131zl\u0131k hali de sona\nerecektir. Kiraya verenin borcu kiralanan\u0131 kirac\u0131n\u0131n kullanmas\u0131na ve\nyararlanmas\u0131na uygun halde bulundurmak olup kirac\u0131n\u0131n borcu da kira bedelini\n\u00f6demektir. Buna g\u00f6re idari tedbir kararlar\u0131 devam etti\u011fi s\u00fcrece kiraya veren ve\nkirac\u0131 bak\u0131m\u0131ndan borcunu yerine getirmesi imk\u00e2ns\u0131zl\u0131k hali yaratacakt\u0131r.<\/p>\n\n\n\n<h4 id=\"h-a-r-i-fa-g-l\">A\u015f\u0131r\u0131 \u0130fa G\u00fc\u00e7l\u00fc\u011f\u00fc:<\/h4>\n\n\n\n<p>Al\u0131nan tedbir karar\u0131 neticesinde \u00e7al\u0131\u015famayan esnaf\u0131n, \u00e7al\u0131\u015famad\u0131\u011f\u0131 i\u00e7in kiray\u0131 \u00f6deyememesi veya \u00f6nemli \u00f6l\u00e7\u00fcde zorlu\u011fa d\u00fc\u015fmesi<a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6098.pdf\"> T\u00fcrk Bor\u00e7lar Kanunu<\/a> Md. 138&#8217;de d\u00fczenlenen a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc halini de g\u00fcndeme getirebilecektir. Bor\u00e7lunun a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fcne dayanmas\u0131 durumunda bor\u00e7luya s\u00f6zle\u015fmeyi direkt olarak s\u00f6zle\u015fmeyi sona erdirme hakk\u0131 tan\u0131nmamaktad\u0131r. TBK\u2019n\u0131n 138.maddesinde aranan \u015fartlar\u0131n varl\u0131\u011f\u0131 halinde bor\u00e7luya h\u00e2kimden s\u00f6zle\u015fmenin yeni ko\u015fullara g\u00f6re uyarlanmas\u0131n\u0131 talep etme hakk\u0131 tan\u0131maktad\u0131r. H\u00e2kiminin, taraflar\u0131n iddia ve taleplerine ba\u011fl\u0131 olmay\u0131p \u0130\u015fyerinin Kapal\u0131 Kald\u0131\u011f\u0131 S\u00fcre, \u0130\u015fyerinin U\u011frad\u0131\u011f\u0131 Zarar, Yap\u0131lacak Uyarlama ile s\u00f6zle\u015fmenin ayakta kal\u0131p kalamayaca\u011f\u0131 hususlar\u0131n\u0131n incelenmesi gerekecektir. E\u011fer yeni ko\u015fullara g\u00f6re uyarlanmas\u0131 m\u00fcmk\u00fcn de\u011filse bor\u00e7lu, s\u00f6zle\u015fmenin feshini talep edebilecektir.<\/p>\n\n\n\n<p>Burada dikkat\nedilmesi gereken husus <strong>TBK madde 138 de belirtildi\u011fi \u00fczere,<\/strong> ilgili kira\ns\u00f6zle\u015fmesinin s\u00fcresi ve amac\u0131 ele al\u0131nd\u0131\u011f\u0131nda k\u0131s\u0131tlanan faaliyetler sebebiyle\nortaya \u00e7\u0131kan ge\u00e7ici durumun ilgili kira s\u00f6zle\u015fmesinden beklenen menfaati\ntamamen ortadan kald\u0131rd\u0131\u011f\u0131 s\u00f6ylenebilirse o zaman kira s\u00f6zle\u015fmesindeki\nbor\u00e7lar\u0131n bu ifa imk\u00e2ns\u0131zl\u0131\u011f\u0131na ba\u011fl\u0131 olarak sona erdi\u011fi kabul edilebilir. <em>Bu kanun h\u00fckm\u00fc hem ta\u015f\u0131n\u0131r hem ta\u015f\u0131nmaz kiralar\u0131 i\u00e7in\nuygulanabilmektedir. <\/em>\u015eartlar\nger\u00e7ekle\u015fti\u011fi takdirde bahsi ge\u00e7en taraf i\u00e7in s\u00f6zle\u015fmeye ba\u011fl\u0131l\u0131k ilkesinin\nuygulanmamas\u0131 ifade edilmektedir.<\/p>\n\n\n\n<p>Kira bedelinin\nuyarlanmas\u0131 i\u00e7in a\u00e7\u0131lan uyarlama davas\u0131nda u\u011fran\u0131lan zarar\u0131n ispat\u0131 kirac\u0131ya\naittir. Yarg\u0131tay 13. Hukuk Dairesi\u2019nin 12.06.2003 tarih ve 2003\/4175 E. Say\u0131l\u0131\nkarar\u0131nda&nbsp; ; <em>\u201cKira uyarlama\ntalebinde bulunan davac\u0131n\u0131n m\u00fccbir sebebin varl\u0131\u011f\u0131 ile i\u015flemin temelinden\n\u00e7\u00f6kt\u00fc\u011f\u00fcn\u00fcn kan\u0131tlanmas\u0131 gerekir<\/em>\u201d denmi\u015ftir. \u00d6zellikle, kamuoyu \u00f6n\u00fcnde\na\u00e7\u0131klanan tedbir kararlar\u0131 ile kapat\u0131lan veya faaliyeti k\u0131s\u0131tlanan i\u015fyerlerin\ni\u00e7in zarar unsurunu ispat etmek zor olmayacakt\u0131r.<\/p>\n\n\n\n<p>Ancak Yarg\u0131tay\u2019\u0131n konuya ili\u015fkin kararlar\u0131nda, uyarlama davalar\u0131nda\nsadece kira bedelinden k\u0131smi indirim yap\u0131labilece\u011fi, kira \u00f6deme takviminin\nMahkemece de\u011fi\u015ftirilemeyece\u011fi belirtilmi\u015ftir. Yarg\u0131tay 6. Hukuk Dairesi\u2019nin\n19.03.2015 tarih ve 2014\/6223 Esas say\u0131l\u0131 karar\u0131nda;&nbsp;<em>\u201cMeydana gelen felaket nedeniyle Mahkemece\nkira paras\u0131ndan yap\u0131lmas\u0131 gereken indirim miktar\u0131 ile yetinilmesi gerekirken,\nayr\u0131ca s\u00f6zle\u015fme \u015fartlar\u0131na da m\u00fcdahale edilerek taraflarca s\u00f6zle\u015fmede ayl\u0131k\nolarak \u00f6denmesi kararla\u015ft\u0131r\u0131lan kira paras\u0131n\u0131n hasat sonunda y\u0131ll\u0131k olarak\n\u00f6denmesine karar verilmesi do\u011fru de\u011fildir\u201d<\/em>&nbsp;\u015feklinde h\u00fck\u00fcm kurulmu\u015ftur.<\/p>\n\n\n\n<h4 id=\"h-ge-ici-i-fa-i-mk-ns-zl\">Ge\u00e7ici \u0130fa \u0130mk\u00e2ns\u0131zl\u0131\u011f\u0131:<\/h4>\n\n\n\n<p>Yukar\u0131da da ifa etti\u011fimiz \u00fczere COV\u0130D-19 salg\u0131n\u0131n\u0131n\ng\u00fcn\u00fcm\u00fczdeki durum ge\u00e7icidir. Kira\ns\u00f6zle\u015fmesinin s\u00fcresine veya amac\u0131na ba\u011fl\u0131 olarak, meydana gelen bir ge\u00e7ici\nimk\u00e2ns\u0131zl\u0131k kira s\u00f6zle\u015fmesinin s\u00fcrd\u00fcr\u00fclmesi temel bak\u0131m\u0131ndan sorun yaratabilir. Durumun ge\u00e7ici olmas\u0131, al\u0131nan tedbir karalar\u0131n\u0131n ortadan kalkacak olmas\u0131\nifan\u0131n ge\u00e7ici olarak imk\u00e2ns\u0131zla\u015ft\u0131\u011f\u0131n\u0131 g\u00f6stermektedir.<\/p>\n\n\n\n<p>&nbsp;Genel olarak ge\u00e7ici ifa imk\u00e2ns\u0131zl\u0131\u011f\u0131ndan s\u00f6z\nedilse de, k\u0131smi h\u00fck\u00fcms\u00fczl\u00fckte oldu\u011fu gibi,&nbsp;<a href=\"https:\/\/www.lexpera.com.tr\/mevzuat\/kanunlar\/turk-borclar-kanunu-6098\/madde-27\">TBK m.27\/son\nf\u0131kra<\/a>&nbsp;h\u00fckm\u00fcne g\u00f6re s\u00f6zle\u015fmenin t\u00fcm\u00fcn\u00fc\nge\u00e7ersiz k\u0131lma gibi, ge\u00e7ici h\u00fck\u00fcms\u00fczl\u00fck ya da k\u0131smi h\u00fck\u00fcms\u00fcz h\u00e2le gelmesine de yol\na\u00e7abilir. Burada yap\u0131lmas\u0131 gereken her durumda somut \u015fartlar\u0131n\nilgili kira s\u00f6zle\u015fmesine yaratt\u0131\u011f\u0131 etkiyi inceleyerek ona g\u00f6re hukuki bir sonu\u00e7\nba\u011flamak. <\/p>\n\n\n\n<p>TBK da ge\u00e7ici imk\u00e2ns\u0131zl\u0131k durumu d\u00fczenlenmemi\u015ftir. Bu\nsebeple h\u00fckm\u00fcn uygulanmas\u0131n\u0131n sonu\u00e7lar\u0131n\u0131n ne olmas\u0131 gerekti\u011fi konusunda\ndoktrindeki g\u00f6r\u00fc\u015fleri incelemek gerekmektedir. Bu konu ile alakal\u0131 bir\u00e7ok g\u00f6r\u00fc\u015f\nbulunmaktad\u0131r. TBK m.136 da&nbsp;\n\u2018\u2019 <em>Borcun ifas\u0131 bor\u00e7lunun sorumlu\ntutulamayaca\u011f\u0131 sebeplerle imk\u00e2ns\u0131zla\u015f\u0131rsa, bor\u00e7 sona erer\u2019\u2019.<\/em> H\u00fckm\u00fcn\u00fcn\nuygulanabilece\u011fi konusunda g\u00f6r\u00fc\u015fler olmas\u0131na ra\u011fmen ilgili kanun maddesini, ani edimli s\u00f6zle\u015fmelerde tam h\u00fck\u00fcms\u00fczl\u00fck h\u00e2line\nuygulanarak \u00e7\u00f6z\u00fcme kavu\u015fturulmamal\u0131d\u0131r. Kira s\u00f6zle\u015fmeleri bak\u0131m\u0131ndan s\u00fcre, ama\u00e7 ve h\u00fck\u00fcmet kararlar\u0131yla yasaklanan\u0131n ne\noldu\u011funa ve bu yasa\u011f\u0131n ilgili kira s\u00f6zle\u015fmesine yaratt\u0131\u011f\u0131 etki dikkate al\u0131narak\nyap\u0131lan ay\u0131r\u0131mlara dayal\u0131 olarak uygulan\u0131p uygulanmamas\u0131na karar verilmesi\ngerekti\u011finin d\u00fc\u015f\u00fcnmekteyiz.<\/p>\n\n\n\n<p>Korona vir\u00fcs sebebiyle al\u0131nan\n\u00f6nlemler kapsam\u0131nda; 26.3.2020 tarihinde Resmi Gazetede yay\u0131nlanan 7226 say\u0131l\u0131 Baz\u0131\nKanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun ile y\u00fcr\u00fcrl\u00fc\u011fe konulan Ge\u00e7ici 2\/1. Maddesi\nile; 1.03.2020 tarihinden 30.06.2020 tarihine kadar i\u015fleyecek i\u015f yeri kira\nbedelinin \u00f6denmemesi durumunda kira s\u00f6zle\u015fmesinin kiraya veren taraf\u0131ndan,\nfeshetme ve tahliye yoluna gitme sebebi olu\u015fturmayaca\u011f\u0131 hususu eklenmi\u015ftir. &nbsp;Bu madde, \u00e7at\u0131l\u0131-\u00e7at\u0131s\u0131z i\u015fyeri ayr\u0131m\u0131\nolmaks\u0131z\u0131n i\u015fyeri kira bedelleri a\u00e7\u0131s\u0131ndan uygulanacakt\u0131r. Di\u011fer kira\ns\u00f6zle\u015fmelerinde kira bedelinin belirlenen s\u00fcre i\u00e7erisinde \u00f6denmemesi durumunda\nmevcut d\u00fczenlemede bir de\u011fi\u015fiklik bulunmamaktad\u0131r.<\/p>\n\n\n\n<ul><li>S\u00f6z konusu d\u00fczenleme ile kira bedellerinin \u00f6denmemesi\nbak\u0131m\u0131ndan muafiyet sa\u011flamamaktad\u0131r. Kirac\u0131lar bu madde ile <strong>yasada belirlenmi\u015f d\u00f6nemde\ni\u015fleyen kira bedelini \u00f6deyemeyen kirac\u0131n\u0131n <\/strong>(kira bedellerini \u00f6demede\ntemerr\u00fcd\u00fc halinde) kiraya verenin fesih ya da tahliye yoluna ba\u015fvurma hakk\u0131 olmayaca\u011f\u0131na\nili\u015fkindir. Dolay\u0131s\u0131yla kirac\u0131n\u0131n s\u00f6zle\u015fmede belirlenen s\u00fcre i\u00e7inde kira\nbedelini \u00f6deme borcu devam edecektir.<\/li><li>Normal \u015fartlarda T\u00fcrk Bor\u00e7lar Kanunu (TBK) md. 352\/\nII uyar\u0131nca; bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde;\nbir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir\nkira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelinin \u00f6denmemesinden dolay\u0131 2 kez yaz\u0131l\u0131\nihtar alan kirac\u0131 aleyhinde tahliye davas\u0131 a\u00e7\u0131labiliyordu. Ayn\u0131 \u015fekilde TBK md.\n315 uyar\u0131nca kirac\u0131, kira bedelini veya yan gideri \u00f6deme borcunu \u00f6demezse,\nkiraya veren yaz\u0131l\u0131 \u015fekilde kirac\u0131ya 30 g\u00fcnden a\u015fa\u011f\u0131 olmamak \u00fczere \u00f6deme i\u00e7in\nbir s\u00fcre vermek ve bu s\u00fcrenin sonunda da kira \u00f6denmezse s\u00f6zle\u015fmeyi feshetme\nhakk\u0131na sahipti. Bu ge\u00e7ici d\u00fczenleme ile mal sahibine s\u00f6zle\u015fmede belirlenen\ntarih aral\u0131\u011f\u0131nda \u00f6denmeyen kira bedeli sebebiyle tahliye davas\u0131 a\u00e7ma ve\ns\u00f6zle\u015fmeyi feshetme hakk\u0131 kald\u0131r\u0131lm\u0131\u015ft\u0131r. <\/li><\/ul>\n\n\n\n<h5 id=\"h-sonu\"><strong>SONU\u00c7: <\/strong><strong><\/strong><\/h5>\n\n\n\n<p>COV\u0130D-19 salg\u0131n\nhastal\u0131\u011f\u0131 ile m\u00fccadele s\u00fcrecinde al\u0131nan tedbirler ve sosyal izolasyonu zorunlu\ntutan \u00f6neriler neticesinde \u00e7al\u0131\u015famayan veya \u00e7al\u0131\u015fma faaliyeti durdurulmu\u015f i\u015f\u00e7i\nve i\u015fverenlerin m\u00fccbir sebebe ba\u011fl\u0131 olarak uygulanacak hukuki kurumlarda ilk\nolarak ilgili kira s\u00f6zle\u015fmesinde salg\u0131n hastal\u0131\u011f\u0131n m\u00fccbir sebep olarak\nbelirlenip belirlenmedi\u011fi hususudur. Kira s\u00f6zle\u015fmesinde buna ili\u015fkin bir\nd\u00fczenleme var ise o d\u00fczenlemenin sonu\u00e7lar\u0131na g\u00f6re hareket etmek gerekir. E\u011fer\nki s\u00f6zle\u015fmede buna ili\u015fkin bir ibare ve d\u00fczenleme yok ise yukar\u0131da incelenen\nifa imk\u00e2ns\u0131zl\u0131\u011f\u0131, k\u0131sm\u0131 ifa imk\u00e2ns\u0131zl\u0131\u011f\u0131 ve a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc kurumlar\u0131n\u0131n\n\u015fartlar\u0131n\u0131n sa\u011flan\u0131p sa\u011flanmad\u0131\u011f\u0131 hususu her somut olay\u0131n ve kira s\u00f6zle\u015fmesinin\ni\u00e7eri\u011fine g\u00f6re incelenmelidir. <\/p>\n\n\n\n<p>Bu a\u00e7\u0131klanan\n\u00f6nemli sebep ile ola\u011fan\u00fcst\u00fc fesih sebepleri; al\u0131nan\nekonomik tedbirle kapsam\u0131nda zorunlu olarak kapat\u0131lan veya faaliyeti\ns\u0131n\u0131rland\u0131r\u0131lan; tiyatro, sinema, g\u00f6steri\nmerkezi, ni\u015fan\/d\u00fc\u011f\u00fcn salonu, \u00e7alg\u0131l\u0131\/m\u00fczikli lokanta\/kafe, gazino, birahane,\ntaverna, kahvehane, k\u0131raathane, kafeterya, her t\u00fcrl\u00fc kapal\u0131 \u00e7ocuk oyun alanlar\u0131\n(AVM ve lokanta i\u00e7indekiler dahil), dernek lokalleri, y\u00fczme havuzu, SPA ve spor\nmerkezleri gibi devam eden kira ili\u015fkileri i\u00e7indir. Zorunlu olarak\nkapat\u0131lmayan, yani ihtiyari olan kapatmalar bak\u0131m\u0131ndan bu destekler s\u00f6z konusu\nde\u011fildir.<\/p>\n\n\n\n<p>Stj. Av.
