{"id":3214,"date":"2019-12-23T10:49:08","date_gmt":"2019-12-23T07:49:08","guid":{"rendered":"https:\/\/www.kureselhukuk.com\/?p=3214"},"modified":"2020-03-06T18:06:59","modified_gmt":"2020-03-06T15:06:59","slug":"calismaizni-yabancilar","status":"publish","type":"post","link":"https:\/\/www.kureselhukuk.com\/en\/calismaizni-yabancilar\/","title":{"rendered":"YABANCILARIN \u00c7ALI\u015eMA \u0130ZN\u0130"},"content":{"rendered":"<p>*Bu \u00e7al\u0131\u015fma yabanc\u0131lar\u0131n \u00e7al\u0131\u015fma izni ve d\u00fczenlemelere ili\u015fkin bilgi vermektedir.<\/p>\n\n\n\n<p>T\u00fcrkiye; kom\u015fu \u00fclkelere nazaran siyasi\nistikrar\u0131, ekonomik ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131, istihdam olanaklar\u0131 ve co\u011frafi konumu\nsebebiyle geli\u015fen ve de\u011fi\u015fen ko\u015fullar ile birlikte g\u00f6\u00e7 politikas\u0131 a\u00e7\u0131s\u0131ndan\nhedef \u00fclke haline gelmi\u015ftir. <a href=\"https:\/\/www.sabah.com.tr\/haberleri\/turkiye\" target=\"_blank\" rel=\"noreferrer noopener\">T\u00fcrkiye<\/a>&nbsp;\u0130statistik Kurumu (<a href=\"https:\/\/www.sabah.com.tr\/haberleri\/tuik\" target=\"_blank\" rel=\"noreferrer noopener\">T\u00dc\u0130K<\/a>) taraf\u0131ndan yap\u0131lan ara\u015ft\u0131rmaya g\u00f6re T\u00fcrkiye\u2019de ikamet eden yabanc\u0131\nuyruklu ki\u015fi say\u0131s\u0131 1 milyon 211 bin 34 \u2018e ula\u015ft\u0131\u011f\u0131 a\u00e7\u0131kland\u0131. &nbsp;Bu say\u0131n\u0131n 919 bin 61 \u2018lik k\u0131sm\u0131 T\u00fcrkiye\u2019 de\noturma ve \u00e7al\u0131\u015fma iznine sahiptir. 2019 y\u0131l\u0131nda T\u00fcrkiye\u2019de ikamet eden yabanc\u0131\nsay\u0131s\u0131 1 milyon 211 B\u0130N 34 iken bu rakam 2018 y\u0131l\u0131nda 856 bin 470, 2017 y\u0131l\u0131nda da 593 bin\n151 olarak kay\u0131tlara ge\u00e7ti. Bu say\u0131n\u0131n y\u0131llara g\u00f6re artmas\u0131n\u0131n sebepleri olarak\nT\u00fcrkiye\u2019nin jeopolitik konumu ve kom\u015fu \u00fclkelerinde meydana gelen sava\u015flar, i\u00e7\nkar\u0131\u015f\u0131kl\u0131klar, ekonomik krizler g\u00f6sterilmektedir.<\/p>\n\n\n\n<h2>&nbsp;G\u00d6\u00c7 ORTAMI VE YABANCI TANIMI<\/h2>\n\n\n\n<p>Yabanc\u0131lar\u0131n \u00c7al\u0131\u015fma izni T\u00fcrkiye i\u00e7in, al\u0131nan g\u00f6\u00e7\u00fcn nitelikli olmas\u0131 ve istihdama kaynak sa\u011flayabilmesi toplumsal d\u00fczen a\u00e7\u0131s\u0131ndan \u00f6nemlidir. \u00c7al\u0131\u015fmam\u0131zda G\u00f6\u00e7 hareketlerinin do\u011furdu\u011fu, g\u00f6\u00e7 politikas\u0131 sonucunda herhangi bir sebeple yabanc\u0131 ki\u015filerin T\u00fcrkiye\u00b4ye geldikten sonra hangi i\u015flemleri yapmas\u0131 gerekir, hangi a\u015famalardan sonra \u00e7al\u0131\u015fma iznine sahip olabilir, \u00e7al\u0131\u015fma iznine sahip olanlar\u0131n oturma izni almas\u0131na gerek var m\u0131d\u0131r, sorunlar\u0131n\u0131n \u00fczerinde duraca\u011f\u0131z. <\/p>\n\n\n\n<h2>KANUNDA YABANCI K\u0130MD\u0130R?<\/h2>\n\n\n\n<p>\u0130lk olarak yabanc\u0131 ne demektedir? <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6458.pdf\">Yabanc\u0131; bir devletin \u00fclkesinde bulunan ve o devletin vatanda\u015f\u0131 olmayan ger\u00e7ek ki\u015filerdir. <\/a>&nbsp;Yabanc\u0131, Yabanc\u0131lar ve Uluslararas\u0131 Koruma Kanunu\u2019nun (YYUK) 3. Maddesinde \u2018\u2019<a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6458.pdf\">T\u00fcrkiye Cumhuriyeti Devleti ile vatanda\u015fl\u0131k ba\u011f\u0131 bulunmayan ki\u015fidir<\/a>\u201d \u015feklinde tan\u0131mlanm\u0131\u015ft\u0131r. Yabanc\u0131lar\u0131n kim oldu\u011fu tespit edilirken bunlar\u0131 kategorize ederek incelemek gerekmektedir. T\u00fcrk kanunlar\u0131na g\u00f6re; ba\u015fka \u00fclke vatanda\u015flar\u0131, vatans\u0131zlar, g\u00f6\u00e7menler, m\u00fclteciler, ikincil korumadan yararlananlar ve az\u0131nl\u0131klar yabanc\u0131 olarak ele al\u0131n\u0131r, bunlar\u0131n yan\u0131nda ge\u00e7ici koruma ad\u0131 alt\u0131nda adland\u0131r\u0131lm\u0131\u015f bir kesim de vard\u0131r. <\/p>\n\n\n\n<h2>DETAYLI YABANCI TANIMLARI<\/h2>\n\n\n\n<p>Vatans\u0131zlar; herhangi bir devletin muhafazas\u0131nda olmayanlard\u0131r. &nbsp; G\u00f6\u00e7menler; \u00e7e\u015fitli nedenlerle bulunduklar\u0131 \u00fclkeyi terk ederek yerle\u015fmek amac\u0131yla ba\u015fka bir \u00fclkeye giden ki\u015fidir. Az\u0131nl\u0131klar; bir \u00fclkede ya\u015fayan ve birbirlerine \u0131rk, din, dil, k\u00fclt\u00fcr ba\u011flar\u0131 ile ba\u011fl\u0131 olan gruplard\u0131r. M\u00fclteciler; vatanda\u015f\u0131 oldu\u011fu memlekette ger\u00e7ekle\u015fen siyasi, ekonomik vb. olaylar sebebiyle bu \u00fclkeyi iradesiyle veya zorla terk etmi\u015f ve yeni bir devletin vatanda\u015fl\u0131\u011f\u0131na ge\u00e7memi\u015f kimselerdir. <\/p>\n\n\n\n<h4>  \u00c7al\u0131\u015fma hakk\u0131 T.C. Anayasas\u0131 <\/h4>\n\n\n\n<p>Peki, T\u00fcrkiye de ikamet eden yabanc\u0131 ki\u015filerin T\u00fcrkiye de hangi \u015fartlar ile \u00e7al\u0131\u015fma iznine sahip oldu\u011funu veya \u00e7al\u0131\u015fma hakk\u0131n\u0131n ne oldu\u011funu, neleri kapsad\u0131\u011f\u0131n\u0131 biliyor musunuz? \u00c7al\u0131\u015fma hakk\u0131 T.C. Anayasas\u0131\u2019nda birka\u00e7 \u015fekilde ele al\u0131nm\u0131\u015ft\u0131r; <a href=\"https:\/\/www.tbmm.gov.tr\/develop\/owa\/tc_anayasasi.maddeler?p3=48\">&#8220;Herkes diledi\u011fi alanda \u00e7al\u0131\u015fma ve s\u00f6zle\u015fme h\u00fcrriyetine sahiptir.\u2019\u2019 \u2018\u2019\u00d6zel te\u015febb\u00fcsler kurmak serbesttir.\u2019\u2019 \u201c\u00c7al\u0131\u015fmak herkesin hakk\u0131 ve \u00f6devidir.\u2019\u2019 <\/a>Bu kanun h\u00fck\u00fcmleriyle yabanc\u0131ya ve vatanda\u015fa e\u015fit haklar tan\u0131nmaktad\u0131r fakat yabanc\u0131lar\u0131n \u00e7al\u0131\u015fma hayat\u0131na kat\u0131l\u0131m\u0131, \u00fclke vatanda\u015flar\u0131na g\u00f6re s\u0131n\u0131rl\u0131 sekt\u00f6rlere indirgenebilir. <\/p>\n\n\n\n<h2>KANUNA G\u00d6RE \u00c7ALI\u015eMA \u0130Z\u0130NLER\u0130<\/h2>\n\n\n\n<p>Yabanc\u0131lar\u0131n \u00e7al\u0131\u015fma izni ve hakk\u0131 i\u00e7 hukukta ele ald\u0131\u011f\u0131m\u0131z gibi s\u00f6zle\u015fmelerin getirdi\u011fi hak ve y\u00fck\u00fcml\u00fcl\u00fckler a\u00e7\u0131s\u0131ndan da ele almam\u0131z gerekir. Bilindi\u011fi gibi T.C. Anayasas\u0131\u00b4n\u0131n 16.maddesinde temel haklar\u0131n milletleraras\u0131 hukuka uygun olarak kanun yolu ile s\u0131n\u0131rland\u0131r\u0131lmas\u0131 kabul edilmi\u015ftir. Anayasa\u00b4da d\u00fczenlenen herkesi kapsayan bu \u00e7al\u0131\u015fma hakk\u0131; Yabanc\u0131lar\u0131n \u0130kamet Ve Seyahatleri Hakk\u0131ndaki Kanunun 15.maddesiyle s\u0131n\u0131rland\u0131r\u0131larak \u2018<a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.3.5683.pdf\">\u2019Yabanc\u0131lar T\u00fcrkiye\u2019de ancak kanunun kendilerine men etmedi\u011fi i\u015fleri tutabilirler\u2019\u2019 \u015feklinde a\u00e7\u0131klanm\u0131\u015ft\u0131r. Ayn\u0131 kanunun 7.maddesinde ise &nbsp;\u201cS\u0131rf i\u015f tutmak i\u00e7in gelecek sanat ve meslek erbab\u0131 olup da tutaca\u011f\u0131 i\u015f, kanunlar gere\u011fince T\u00fcrk vatanda\u015flar\u0131na hasredilmi\u015f bulunan yabanc\u0131lara ikamet teskeresi verilmez\u2026\u201d <\/a>denilmi\u015ftir. Yabanc\u0131lar\u0131n yasakland\u0131\u011f\u0131 birtak\u0131m i\u015fler vard\u0131r. Bunlar 6735 say\u0131l\u0131 <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6735.pdf\">Uluslararas\u0131 \u0130\u015fg\u00fcc\u00fc Kanunu<\/a> 6. Maddesinde de s\u0131ralanm\u0131\u015ft\u0131r. Bunlar\u0131n yan\u0131nda yabanc\u0131 ger\u00e7ek ki\u015filerin kimler olabilece\u011fini yukar\u0131da g\u00f6rd\u00fck, peki bu yabanc\u0131lar\u0131n \u00e7al\u0131\u015fma izinleri de farkl\u0131l\u0131k g\u00f6sterecek mi? <\/p>\n\n\n\n<h2>\u00c7ALI\u015eMA \u0130ZN\u0130 VE \u0130\u015e G\u00dcC\u00dc KANUNU<\/h2>\n\n\n\n<p>Vatans\u0131zlar i\u00e7in ilk olarak G\u00f6\u00e7 \u0130daresi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan ki\u015finin vatans\u0131z olup olmad\u0131\u011f\u0131n\u0131n tespiti yap\u0131lacakt\u0131r ve vatans\u0131z ki\u015fiye kimlik belgesi verilecektir. Bu kimlik belgesi ile vatans\u0131z ki\u015filer ikamet izninden ( 2 y\u0131lda bir d\u00fczenlenmek \u015fart\u0131yla ) muaf olacaklard\u0131r. Vatans\u0131z ki\u015filerin \u00e7al\u0131\u015fma izni Uluslararas\u0131 \u0130\u015f G\u00fcc\u00fc Kanunu\u2019na tabiidir. U\u0130K madde 16\/1-f bendinde vatans\u0131zlar\u0131n istisnai olarak \u00e7al\u0131\u015fma izni verilece\u011fi d\u00fczenlenmi\u015ftir.,<\/p>\n\n\n\n<h2>GE\u00c7\u0130C\u0130 K\u0130ML\u0130K BELGELER\u0130 VE \u00c7ALI\u015eMA \u0130ZN\u0130<\/h2>\n\n\n\n<p>M\u00fclteciler; g\u00fcn\u00fcm\u00fczde yanl\u0131\u015f benimsenmi\u015f bir kavramd\u0131r. \u0130\u00e7 sava\u015f dolas\u0131yla d\u00fcnyan\u0131n bir\u00e7ok yerine da\u011f\u0131lan ve \u0130<a href=\"https:\/\/www.goc.gov.tr\/yillik-goc-raporlari\">\u00e7i\u015fleri Bakanl\u0131\u011f\u0131&#8217;n\u0131n a\u00e7\u0131klad\u0131\u011f\u0131 veriler do\u011frultusunda  ise bahsi ge\u00e7en&nbsp;Suriyeli&nbsp;g\u00f6\u00e7menlerin yakla\u015f\u0131k 3 milyon 614 bini&nbsp;T\u00fcrkiye&#8217;de&nbsp;ya\u015famaktad\u0131r.<\/a> Genel olarak Suriyelilere m\u00fclteci s\u0131fat\u0131 verilmi\u015f olsa da hukuken m\u00fclteciler; Avrupa \u00fclkelerinde meydana gelen ve zulme u\u011frayaca\u011f\u0131ndan hakl\u0131 sebeplerle korktu\u011fu i\u00e7in kendi \u00fclkesini terk eden ki\u015fiye verilen stat\u00fcd\u00fcr. Bu stat\u00fcye sahip ki\u015filere de uluslararas\u0131 koruma stat\u00fcs\u00fc sahibi kimlik belgesi verilmektedir,&nbsp; bu belge hem ikamet izni yerine ge\u00e7mekte hem de \u00e7al\u0131\u015fma izni belgesi yerine ge\u00e7mektedir.<\/p>\n\n\n\n<h2>\u015eARTLI M\u00dcLTEC\u0130 KAVRAMI NED\u0130R?<\/h2>\n\n\n\n<p>Avrupa \u00fclkeleri d\u0131\u015f\u0131nda meydana gelen olaylar sebebiyle; \u0131rk, din, dil, belli bir <a href=\"https:\/\/www.goc.gov.tr\/multeci\">gruba mensubiyeti veya siyasi d\u00fc\u015f\u00fcncelerinden dolay\u0131 zulme u\u011frayaca\u011f\u0131ndan hakl\u0131 sebeplerle korktu\u011fu i\u00e7in vatanda\u015f\u0131 <\/a>oldu\u011fu \u00fclkeden ayr\u0131lmak zorunda kalan veya ayr\u0131ld\u0131\u011f\u0131 \u00fclkeye geri d\u00f6nemeyecek olan ki\u015filere de \u015fartl\u0131 m\u00fclteci stat\u00fcs\u00fc verilmektedir. Bu ki\u015filerin, g\u00fcvenli 3.\u00fclkelere yerle\u015ftirilene kadar T\u00fcrkiye\u2019de kalmas\u0131na izin verilir ve kendilerine uluslararas\u0131 koruma kimlik belgesi verilir, bu kimlik belgesi sadece ikamet izni yerine ge\u00e7mektedir, \u00e7al\u0131\u015fma izni yerine ge\u00e7memektedir. \u015eartl\u0131 m\u00fcltecilerin \u00e7al\u0131\u015fma izni almas\u0131 i\u00e7in<a href=\"https:\/\/www.resmigazete.gov.tr\/eskiler\/2016\/08\/20160813-1.htm\"> U\u0130K Madde 16 kapsam\u0131nda istisnai olarak \u00e7al\u0131\u015fma izni almak i\u00e7in ba\u015fvuruda bulunmas\u0131 gerekmektedir.<\/a><\/p>\n\n\n\n<h2>ULUSLARARASI KORUMA STAT\u00dcS\u00dc <\/h2>\n\n\n\n<p>T\u00fcrkiye\u2019ye gelmi\u015f yabanc\u0131 ger\u00e7ek ki\u015filer, kural olarak \u00e7al\u0131\u015fma izni veya \u00e7al\u0131\u015fma muafiyeti olmadan veya taraflar aras\u0131 anla\u015fmalarla muafiyet durumu s\u00f6z konusu olmadan \u00e7al\u0131\u015famazlar. \u00c7al\u0131\u015fma hakk\u0131, istinas\u0131z herkese tan\u0131nmas\u0131 gereken temel insan haklar\u0131ndan birisidir. Bir insan\u0131n ya\u015fam hakk\u0131d\u0131r ve her insan\u0131n ya\u015fam\u0131n\u0131 idame ettirebilmesi i\u00e7in \u00e7al\u0131\u015fma hakk\u0131na sahip olmas\u0131 gerekmektedir. T\u00fcrkiye bir\u00e7ok yabanc\u0131n\u0131n ikamet etti\u011fi bir \u00fclke durumundad\u0131r ve her devlet gibi T\u00fcrkiye\u2019de vatanda\u015flar\u0131 d\u0131\u015f\u0131nda yabanc\u0131lar\u0131nda<a href=\"https:\/\/www.kureselhukuk.com\/en\/insan-haklari-evrensel-bildirgesi-insan-haklari-tamzinat-komisyonu\/\"> \u00e7al\u0131\u015fma hakk\u0131n\u0131n s\u0131n\u0131rlar\u0131n\u0131 i\u00e7eren hukuki d\u00fczenlemeler <\/a>yapm\u0131\u015ft\u0131r. Bu konuda en temel kayna\u011f\u0131m\u0131z Uluslararas\u0131 \u0130\u015f G\u00fcc\u00fc Kanunu\u2019dur. Her \u015feyden \u00f6nce baz\u0131 tan\u0131mlar\u0131n \u00fczerinde durmam\u0131z gerekir. \u00c7al\u0131\u015fma izni nedir? \u00c7al\u0131\u015fma izni Bakanl\u0131k\u00e7a resmi bir belge \u015feklinde d\u00fczenlenen ve ge\u00e7erlilik s\u00fcresi i\u00e7erisinde yabanc\u0131ya \u00e7al\u0131\u015fma ve ikamet izni veren belge niteli\u011findedir. \u00c7al\u0131\u015fma izni ba\u011f\u0131ml\u0131 ve ba\u011f\u0131ms\u0131z \u00e7al\u0131\u015fma izni olarak da ayr\u0131lmaktad\u0131r; ba\u011f\u0131ms\u0131z \u00e7al\u0131\u015fma yabanc\u0131n\u0131n kendi nam ve hesab\u0131na \u00e7al\u0131\u015fmas\u0131d\u0131r, ba\u011f\u0131ml\u0131 \u00e7al\u0131\u015fma ise yabanc\u0131n\u0131n bir ba\u015fkas\u0131n\u0131n nam hesab\u0131na i\u015f g\u00f6rmesidir. <\/p>\n\n\n\n<h2>\u00c7ALI\u015eMA \u0130ZN\u0130 BA\u015eVURU VE PROSED\u00dcRLER\u0130<\/h2>\n\n\n\n<p>\u00c7al\u0131\u015fma izni ba\u015fvurular\u0131 ilk olarak yurt i\u00e7inden yap\u0131lacaksa do\u011frudan \u00c7al\u0131\u015fma Ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131na, yurtd\u0131\u015f\u0131nda yap\u0131lacaksa bulundu\u011fu \u00fclkedeki T\u00fcrkiye Cumhuriyeti B\u00fcy\u00fckel\u00e7ilikleri veya Ba\u015fkonsolosluklar\u0131na yap\u0131lmal\u0131d\u0131r. T\u00fcrkiye\u2019ye \u00e7al\u0131\u015fmak i\u00e7in gelen yabanc\u0131n\u0131n, hangi i\u015f kolunda \u00e7al\u0131\u015fmak istedi\u011fini bildiren m\u00fcracaat\u0131 \u00fczerinde i\u00e7i\u015fleri bakanl\u0131\u011f\u0131nda bildirilir. \u00c7al\u0131\u015fma izni ba\u015fvurular\u0131 uluslararas\u0131 i\u015f g\u00fcc\u00fc politikas\u0131na g\u00f6re de\u011ferlendirilmektedir ve bakanl\u0131k\u00e7a gerek g\u00f6r\u00fclen hallerde ilgili kamu kurum ve kurulu\u015flar\u0131n\u0131n g\u00f6r\u00fc\u015fleri de al\u0131nmaktad\u0131r. Yap\u0131lan ba\u015fvurular bakanl\u0131k taraf\u0131ndan 30 g\u00fcnl\u00fck s\u00fcre i\u00e7erisinde olumlu veya olumsuz \u015feklinde sonu\u00e7land\u0131r\u0131l\u0131r. \u00c7al\u0131\u015fma izni verme idarenin takdirinde bir yetkidir, Fakat U\u0130K\u2019n\u0131n 9.maddesinde say\u0131l\u0131 sebeplerin varl\u0131\u011f\u0131 halinde t\u00fcm \u015fartlar sa\u011flansa dahi idare \u00e7al\u0131\u015fma izni vermeyebilir.<\/p>\n\n\n\n<h2>\u00c7ALI\u015eMA \u0130ZN\u0130\nT\u00dcRLER\u0130 NELERD\u0130R?<\/h2>\n\n\n\n<h2>&nbsp;<\/h2>\n\n\n\n<p>Kanunumuzda ve y\u00f6netmeliklerde d\u00fczenlenen be\u015f\nt\u00fcr \u00e7al\u0131\u015fma izni bulunmaktad\u0131r. Bunlar; s\u00fcreli \u00e7al\u0131\u015fma izni, s\u00fcresiz \u00e7al\u0131\u015fma\nizni, ba\u011f\u0131ms\u0131z \u00e7al\u0131\u015fma izni, turkuaz karl\u0131lara ili\u015fkin d\u00fczenleme, istisnai\n\u00e7al\u0131\u015fma iznidir.<\/p>\n\n\n\n<ul><li>\u00b7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <a href=\"https:\/\/kms.kaysis.gov.tr\/Home\/Goster\/35643?AspxAutoDetectCookieSupport=1\">S\u00fcreli \u00e7al\u0131\u015fma izni; olumlu sonu\u00e7lanan \u00e7al\u0131\u015fma izni ba\u015fvurusunun i\u015f veya hizmet s\u00f6zle\u015fmesinin s\u00fcresini a\u015fmamak ko\u015fulu ile ve belirli bir i\u015fte \u00e7al\u0131\u015fmak \u015fart\u0131yla ilk ba\u015fvuruda 1 y\u0131l\u0131 a\u015fmamak \u00fczere verilen \u00e7al\u0131\u015fma iznidir. \u0130\u015f\u00e7i, ayn\u0131 i\u015fverenin i\u015f kolu \u00fczerinden devam ederek \u00e7al\u0131\u015f\u0131l\u0131rsa; ilk uzatmada en \u00e7ok 2 y\u0131l, sonraki uzatma ba\u015fvurular\u0131nda ise en \u00e7ok 3 y\u0131la kadar \u00e7al\u0131\u015fma izni verilebilir. Profesyonel meslek mensuplar\u0131n\u0131n ve \u00e7al\u0131\u015fma izninde bulunan yabanc\u0131n\u0131n; e\u011fitim d\u00fczeyi, mesleki deneyimi, bilim ve teknolojiye katk\u0131s\u0131 vb. etkenlerle bakanl\u0131k\u00e7a belirlenecek di\u011fer hususlar\u0131n dikkate al\u0131n\u0131m\u0131yla verilir.<\/li><li>\u00b7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Turkuaz kartl\u0131lara ili\u015fkin \u00e7al\u0131\u015fma izni; ayn\u0131 zamanda ikamet izni de sa\u011flar, ilk 3 y\u0131l ge\u00e7ici olarak verilir, 3 y\u0131l\u0131n dolmas\u0131na 180 g\u00fcn kalmas\u0131ndan itibaren yeni ba\u015fvuru yap\u0131lmas\u0131 gerekmektedir. M\u00fclteci ve ikincil koruma stat\u00fcs\u00fc ki\u015filere; do\u011frudan \u00e7al\u0131\u015fma ve ikamet izni sa\u011flamaktad\u0131r. Bu ki\u015filerin de \u00e7al\u0131\u015fma izninden muaf oldu\u011funu Bakanl\u0131\u011fa bildirmesi zorunludur, Bakanl\u0131k gerekli de\u011ferlendirmeleri yapt\u0131ktan sonra \u00e7al\u0131\u015fma izni muafiyet belgesi verecektir. Uluslararas\u0131 Koruma Kanunu\u2019nda tan\u0131mlanan m\u00fclteci ve ikincil koruma stat\u00fcs\u00fcnden yararlanan ki\u015filer haricinde ikamet izni \u00e7al\u0131\u015fma izni hakk\u0131n\u0131 vermemektedir. Uluslararas\u0131 koruma talebinde bulunanlar ve \u015fartl\u0131 m\u00fclteciler ba\u015fvuru tarihinden;&nbsp; ge\u00e7ici koruma sa\u011flanan yabanc\u0131lar ise ge\u00e7ici koruma kimlik belgesinin d\u00fczenlendi\u011fi tarihten itibaren 6 ay sonra \u00e7al\u0131\u015fma izni almak i\u00e7in ba\u015fvurmas\u0131 gerekmektedir. \u00c7al\u0131\u015fma izni ve \u00e7al\u0131\u015fma izni muafiyeti s\u00fcrenin sona ermesiyle veya bakanl\u0131k taraf\u0131ndan iptal edilmesiyle sona erer. \u0130UK 15.maddesinde say\u0131l\u0131 hallerin ger\u00e7ekle\u015fmesi durumunda \u00e7al\u0131\u015fma izni veya muafiyeti bakanl\u0131k\u00e7a iptal edilir. <\/p>\n\n\n\n<h2>SUR\u0130YEL\u0130LER\nVE KORUMA STAT\u00dcS\u00dc<\/h2>\n\n\n\n<ul><li>yabanc\u0131lar\u0131n \u00e7al\u0131\u015fma izni<\/li><\/ul>\n\n\n\n<p>Suriyeliler i\u00e7in olu\u015fturulmu\u015f ge\u00e7ici koruma stat\u00fcs\u00fc daha kapsaml\u0131 haklar tan\u0131maktad\u0131r. Ge\u00e7ici koruma stat\u00fcs\u00fc sahipleri \u00e7al\u0131\u015fma izinlerini istisnai olarak almaktad\u0131r. Suriye\u2019den gelenler ge\u00e7ici koruma kimlik belgesini ald\u0131ktan 6 ay sonra \u00e7al\u0131\u015fma izni de alabilirler. Bu konuda iki temel y\u00f6netmelik mevcuttur. Bunlar; Ge\u00e7ici Koruma \u00c7al\u0131\u015fma \u0130znine \u0130li\u015fkin Y\u00f6netmelik ve Uluslararas\u0131 Koruma Ba\u015fvuru Sahiplerine \u0130li\u015fkin Y\u00f6netmelik\u2019tir. Bu konuda en \u00f6nemli nokta kota konusudur. Bir i\u015fyerinde en fazla %10\u2019luk ge\u00e7ici koruma stat\u00fcs\u00fcne sahip i\u015f\u00e7i \u00e7al\u0131\u015fabilmektedir. Ge\u00e7ici koruma stat\u00fcs\u00fc, \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019n\u0131n teklifi ile Bakanlar Kurulu\u2019nun karar\u0131yla olur ve s\u00fcreli olarak verilir. Bu stat\u00fc sahibi ki\u015filer; sa\u011fl\u0131k, e\u011fitim,\u00a0 vb. gibi temel insan haklar\u0131ndan aynen yararlan\u0131rlar ve T\u00fcrk\u00e7e bilme zorunluluklar\u0131 yoktur. Kimlerin ge\u00e7ici koruma stat\u00fcs\u00fcne sahip olaca\u011f\u0131nda dair Ge\u00e7ici Koruma Y\u00f6netmeli\u011fi \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r, y\u00f6netmeli\u011fin 8.maddesinde kimlerin ge\u00e7ici koruma alt\u0131na al\u0131nmayaca\u011f\u0131 say\u0131lm\u0131\u015ft\u0131r. <\/p>\n\n\n\n<h2>YABANCI \u00dcLKE\nVATANDA\u015eLARI<\/h2>\n\n\n\n<ul><li>yabanc\u0131lar\u0131n \u00e7al\u0131\u015fma izni<\/li><\/ul>\n\n\n\n<p>Uluslararas\u0131 koruma kapsam\u0131na girmeyen yabanc\u0131lar \u00e7al\u0131\u015fma ve ikamet izinlerini nas\u0131l alacak, onlar nas\u0131l bir yol izleyecek? G\u00f6\u00e7 idaresinin Yabanc\u0131lar Ve Uluslararas\u0131 Koruma Kanununun 19. maddesinin 1. f\u0131kras\u0131nda; T\u00fcrkiye\u2019de, vizenin veya vize muafiyetinin tan\u0131d\u0131\u011f\u0131 s\u00fcreden ya da doksan g\u00fcnden fazla kalacak yabanc\u0131lar\u0131n ikamet izni almas\u0131n\u0131n zorunlu oldu\u011fu, ikamet izninin, alt\u0131 ay i\u00e7inde kullan\u0131lmaya ba\u015flanmad\u0131\u011f\u0131nda ise ge\u00e7erlili\u011fini kaybedece\u011fi ifade edilmi\u015ftir. T\u00fcrkiye\u2019ye gelen yabanc\u0131lar; ikamet izni ba\u015fvurular\u0131n\u0131 yasal olarak vatanda\u015f\u0131 oldu\u011fu \u00fclkedeki T\u00fcrk Konsoloslu\u011fu\u2019na yapmal\u0131lard\u0131r. \u0130kamet izni ba\u015fvuru yapacak yabanc\u0131larda; talep ettikleri ikamet izni s\u00fcresinden altm\u0131\u015f g\u00fcn daha uzun s\u00fcreli pasaport ya da pasaport yerine ge\u00e7en belgeye sahip olmalar\u0131 \u015fart\u0131 aran\u0131r. Yap\u0131lan ba\u015fvurular konsolosluklar taraf\u0131ndan genel m\u00fcd\u00fcrl\u00fc\u011fe iletilir, Genel M\u00fcd\u00fcrl\u00fck, gerekli g\u00f6rd\u00fc\u011f\u00fcnde ilgili kurumlar\u0131n g\u00f6r\u00fc\u015flerini de alarak ba\u015fvurular\u0131 sonu\u00e7land\u0131rd\u0131ktan sonra, ikamet izninin d\u00fczenlenmesi ya da ba\u015fvurunun reddedilmesi i\u00e7in konsoloslu\u011fa bilgi verir, ba\u015fvurular en ge\u00e7 \u00a0\u00a0\u00a0\u00a0\u00a0 90 g\u00fcn i\u00e7erisinde sonu\u00e7land\u0131r\u0131l\u0131r.\u00a0\u00a0 YUKK madde 21\/7 de ise ikamet izni ba\u015fvurular\u0131 yetkili arac\u0131 kurum taraf\u0131ndan da yap\u0131labilece\u011fi d\u00fczenlenmi\u015ftir.
